Dr Michael Baird, who analysed the results of a March 21 DNA test, announced the results outside the court in Nassau, Bahamas, where a closed hearing in a legal battle for custody of the girl was heard. "Essentially, he’s the biological father," Baird told reporters.

A jubilant Birkhead said: "My baby’s going to be coming home pretty soon."

The court hearing left unanswered the question of who will have custody of the girl, who could inherit hundreds of millions of dollars.

"I told you so!" a jubilant Birkhead said as he emerged from the pale pink colonial courthouse in downtown Nassau. He then embraced Howard K Stern, the former Playboy Playmate’s lawyer and companion who was listed as the father on the birth certificate, and Stern said he would not challenge Birkhead for custody.

Smith, 39, died in February in Florida, five months after Dannielynn was born in a Nassau hospital. Birkhead, a California photographer, had been fighting for custody of Dannielynn even before Smith’s death.

"Nothing’s been determined except parentage and I’m the father," Birkhead said. "It’s been a long road and I’m just happy to have this behind me."

But a lawyer for Smith’s mother, Virgie Arthur, indicated she might seek joint custody at another hearing on Friday. Arthur, who had been estranged from Smith for years, said she wanted to be present in her granddaughter’s life, but seemed appeased by the DNA results.

"I’m happy that Dannielynn will know who her real father is," she said outside court. Stern insisted he loved the baby despite the DNA results, saying: "I’m obviously very disappointed, but my feelings for Dannielynn have not changed."

The baby, whose full name is Dannielynn Hope Marshall Stern, could inherit millions from the estate of Smith’s late husband, J Howard Marshall II. The former model had been fighting the Texas oil tycoon’s family over his estimated 500 million dollar (£250 million) fortune since his death in 1995.

The Bahamas Supreme Court is expected to hold a hearing later in the paternity case of Anna Nicole Smith’s daughter.

But lawyers and officials are prohibited by Bahamian legal rules from discussing the case, even to reveal the nature of the hearing.

The baby, Dannielynn Hope Marshall Stern, could inherit millions from the estate of the model’s late husband, Howard Marshall.

Anna Nicole, who collapsed and died on February 8 in Florida from an accidental overdose, had been fighting the Texas oil tycoon’s family over his estimated 500 million dollars fortune since his death in 1995.

Howard Stern, Anna Nicole’s partner, dropped his bid to halt the use of DNA to prove the paternity of the former Playboy Playmate’s daughter when it appeared a Bahamas court was going to reject his appeal.

His lawyer withdrew the challenge in the face of sceptical questioning by a three-judge panel of the Court of Appeal.

Biography

Vickie Lynn Hogan, better known as Anna Nicole Smith, was born on November 28 1967 in Houston, Texas and raised in nearby Mexia by her mother after her father left the family. 
Although she had aspirations to become ’the next Marilyn Monroe’, Vickie began working at Jim’s Krispy Fried Chicken where she met her first husband, Billy Wayne Smith.  They married when Vickie was just seventeen.  The next year she gave birth to their son Daniel and in 1987 seperated from her husband, finding work as an exotic dancer in Houston.

Whilst working as a stripper she met elderly millionaire J. Howard Marshall, with whom she began a relationship despite the sixty three year age gap.  In 1994 the couple married amid much tabloid excitement.  Marshall died thirteen months later, leaving nothing to his young wife.

In the interim Vickie, now going by the name Anna Nicole Smith, appeared on the front cover of Playboy, being made Playmate of the Year by Hugh Hefner.  She bagged a deal with Guess?, replacing supermodel Claudia Schiffer and finding herself a household name.  Meanwhile Anna Nicole battled Marshall’s sons in the courts for her share of her late husbands millions, however she was eventually bankrupted and ordered to pay $1million dollars in fees.  She was again given the right to fight for her entitlement following the death of her stepson.

Anna Nicole’s acting career was much less publicised than her marriage, although she appeared in high profile films The Hudsucker Proxy and Naked Gun 33 1/3.  Her bigger roles came in smaller films such as To The Limit and Skyscraper and on television, appearing as herself in wacky reality TV series The Anna Nicole Show.  She later apeared in Be Cool and Wasabi Tuna.

On September 7 2006 Anna Nicole gave birth to a daughter, Dannielynn Hope Marshall Stern, claiming the father was her lawyer Howard K Stern, although her ex boyfriend, Larry Birkhead, claimed the child as his.  Three days later her son, Daniel, died of an apparent drug overdose while visiting his mother and half sister in hospital.  Later that same month Anna Nicole and Howard K Stern exchanged vows in a commitment ceremony in the Bahamas.

On February 8 2007, the day after a date for a paternity test on her daughter had been set, Anna Nicole collapsed at a hotel in Florida and later died.  An autopsy has yet to determine the cause of death.
