The judges said the challenge was filed too late and his objections should have been raised before the Supreme Court ordered DNA testing in the paternity challenge filed by Anna Nicole’s ex, Larry Birkhead.
Justice Emmanuel Osadebay noted that Mr Stern himself had agreed to DNA testing - and even suggested an expert to do the analysis - but waited until a week after the sample was taken to file the a challenge to the court’s decision.
"His problem is that the person he wanted to do the testing was not the one selected by the court," Osadebay said.

Former Playboy model Anna Nicole Smith was killed by a lethal combination of an accidental overdose of sleeping medication together with other prescription drugs, authorities in the US have announced.
Foul play had been ruled out and the case was effectively now closed, police said, ending weeks of speculation over her sudden death.

In total, around nine prescription drugs were found in her blood though not all contributed to her death, the autopsy ruled.
An infection in her left buttock stemming from a previous injection of drugs, together with a case of flu, also contributed.
Addictive drugs such as opiates and cocaine were not found in the tragic starlet’s system, and there was no evidence of illegal drugs in the room where she was found unconscious, nor of disease.
Detectives checked a laptop computer belonging to her partner Howard Stern and discovered no evidence suggesting criminal activity.
"We found nothing to indicate any foul play," Seminole Police chief Charlie Tiger said.
"We are convinced based on an extensive review of the evidence that this case is an accidental overdose with no other criminal elements present."

Although she had aspirations to become ’the next Marilyn Monroe’, Vickie began working at Jim’s Krispy Fried Chicken where she met her first husband, Billy Wayne Smith. They married when Vickie was just seventeen. The next year she gave birth to their son Daniel and in 1987 seperated from her husband, finding work as an exotic dancer in Houston.
Whilst working as a stripper she met elderly millionaire J. Howard Marshall, with whom she began a relationship despite the sixty three year age gap. In 1994 the couple married amid much tabloid excitement. Marshall died thirteen months later, leaving nothing to his young wife.
In the interim Vickie, now going by the name Anna Nicole Smith, appeared on the front cover of Playboy, being made Playmate of the Year by Hugh Hefner. She bagged a deal with Guess?, replacing supermodel Claudia Schiffer and finding herself a household name. Meanwhile Anna Nicole battled Marshall’s sons in the courts for her share of her late husbands millions, however she was eventually bankrupted and ordered to pay $1million dollars in fees. She was again given the right to fight for her entitlement following the death of her stepson.
Anna Nicole’s acting career was much less publicised than her marriage, although she appeared in high profile films The Hudsucker Proxy and Naked Gun 33 1/3. Her bigger roles came in smaller films such as To The Limit and Skyscraper and on television, appearing as herself in wacky reality TV series The Anna Nicole Show. She later apeared in Be Cool and Wasabi Tuna.
On September 7 2006 Anna Nicole gave birth to a daughter, Dannielynn Hope Marshall Stern, claiming the father was her lawyer Howard K Stern, although her ex boyfriend, Larry Birkhead, claimed the child as his. Three days later her son, Daniel, died of an apparent drug overdose while visiting his mother and half sister in hospital. Later that same month Anna Nicole and Howard K Stern exchanged vows in a commitment ceremony in the Bahamas.
On February 8 2007, the day after a date for a paternity test on her daughter had been set, Anna Nicole collapsed at a hotel in Florida and later died. An autopsy has yet to determine the cause of death.
